A judge just got around this by connecting 27 lawsuits and issued an injunction because it is not an injunction for the entire country! I think the Judges name is Moss. It is 27 states attorney generals combining under this suit.

It's not 27 different lawsuits; it's one lawsuit with a bunch of states as plaintiffs. The problem there is that an injunction that applies even in 27 states still leaves 23 states in which an unlawful policy may nevertheless be in effect. That's why there's so much focus on whether/when nationwide class-actions are viable.

Thank you Steve and Katie for this comprehensive discussion on the class action process!!

I think what weighs so heavily on most of us listening is how much faith we've all lost in SCOTUS. It's clearly apparent they are not a non partisan body of justice officials. I think many of us have no confidence in the Supreme court any longer , especially now that they reveal the weakness of not only their personal ethics(Taking favors undeclared) but also their professional ethics. It feels like we're falling down the rabbit hole and wonderland is fraught with horrors waiting.

Alexandra, I agree; in my opinion, SCOTUS is mentally unfit to hear cases without bias/fear. We have justices who favor Trump, or is it fear? If the Supreme Court cannot hear a case without bias or fear of repercussions, then these Justices are not doing their job for We the People. The fact that Chief Justice Roberts gave Trump immunity shows that he is mentally unsuitable to complete his job due to fear of Trump, so he must vacate his seat due to incompetence. Chief Justice Roberts does not have the clear mind to make these types of decisions. He should be impeached along with Alito and Thomas. The Supreme Justices work for the people; they are a check and balance system to make sure unchecked power does not become extremely reckless. Right now, we have immigrants and Americans being kidnapped off the street, said immigrants sent to detention centers outside of their place of origin. Birthright citizenship questions. What's next? Next, the people who are protesting against these ICE agents and bounty hunters are pointing guns at said protesters-this happened in Los Angeles yesterday. Next will be shooting Americans who are protesting. The scene in Los Angeles is ripe for this to happen. This is unchecked power. Sorry, I'm going in a direction outside of class action lawsuits, but I believe the unchecked power will make class action lawsuits more difficult with the Supreme Court Justices overpowering a lower court's ruling in favor of Trump.

Katie, Steve, if you feel I am wrong, I'm good with constructive criticism.

I missed a few minutes of this conversation. Have you talked about the rulings the Supreme Court has made in recent years to weaken the ability of people to gain relief through class actions?

Voter Fraud. A case starts in Rockland County NY in September 2025. I am sure once it starts, a slew of other states will join forces, which will lead Felon tRump to put forth an EO, which I think the Class Action may come into play. States; especially swing states file now before the 30 day (July 27). Wouldn't that filing stop it from being a class action suit?

If the Trump administration uses class action lawsuits can they judge shop because they can choose the location?

When Justice Barrett says: "...We observe only this: Justice Jackson decries an imperial Executive while embracing an imperial Judiciary...", I say yes. What the six Christian Nationalists don't seem to understand is that the Supreme Court's job is to protect the Constitutional rights of the individual. The Court could have said, no we're not going to rule on whether a circuit judge can make a nation wide injunction, the parties are to provide briefs on the merits. But instead, the six stood with the Felon in his lawlessness.

With the full support of the six Christian Nationalists on the Supreme Court and GOP Congressional members the Felon is making the United States an authoritarian theocracy, with the Felon as its leader and the American oligarchs running the Country.
